Sealed Bid

The City of Bad Axe shall consider sealed bids for the purchase of approximately 3.21 acres of real property within the City limits, for the purpose of building an indoor hockey arena. Sealed bids meeting the criteria of this notice will be accepted until July 31, 2025, at 4:00 p.m. at the Bad Axe City Hall, Attn: Rebecca Bachman, 300 E. Huron Avenue, Bad Axe, Michigan 48413.

Commencing at the South 1/4 Corner of Fractional Section 19, T16N-R13E, City of Bad Axe, Michigan; thence N02°10’32” W 647.00 feet along the North-South 1/4 Line of said Fractional Section 19; thence S86°07’31” W 944.03 feet to the Point of Beginning:  RUNNING THENCE S86°07’31” W 283.00 feet; thence N02°11’10” W 498.39 feet; thence N87°48’50” E 282.88 feet; thence S02°11’10” E 490.05 feet to the Point of Beginning.  Being a part of the Southwest 1/4 of Fractional Section 19, T16N-R13E, City of Bad Axe, Huron County, Michigan and containing 3.21 acres of land.  Together with a 33 foot easement being 16.50 feet as measured on each side and at right angles to a centerline described as commencing at the South 1/4 Corner of said Fractional Section 19 thence N02°10’32” W 647.00 feet along the North-South 1/4 Line of said Fractional Section 19; thence S86°07’31” W 944.03 feet; thence 2°11’10’ W 490.05 feet; thence S87°48’50” W 266.38 feet to the Point of Beginning:  RUNNING THENCE N02°11’10” W 208.65 feet; thence N30°25’14” W 115.01 feet; thence N05°17’50” W 180.02 feet; thence N12°17’04” W 97.53 feet; thence S88°33’29”  W 371.33 feet to the Point of Termination at the Easterly Right of Way Line of Hanselman Street. Subject to easements and rights of way of record.

Parcel ID: being a portion of #51-800-019-00 located in Bad Axe, Huron County Michigan.

Seller will provide a Quitclaim Deed at closing. Said deed shall include a provision indicating that in the event the Purchaser fails to construct an indoor hockey arena within one year of closing, title to the property shall automatically revert to the City.  Seller may elect to purchase title insurance at their sole expense.

INSTRUCTIONS FOR BID:

1.         The City of Bad Axe is offering for sale the above-described premises located in              The City of Bad Axe, Huron County, Michigan. Offers will only be accepted as provided via sealed bid pursuant to these instructions. Bidder shall have financial arrangements made available in a manner to close within 45 days from acceptance of bid.

2.         Bids must be in writing and contain name, address, telephone number, specific total bid amount, and must be placed in an envelope and sealed. Bids must specifically state that the bidder intends to construct an indoor hockey arena on the property.

3.         A deposit of $500 must be included with the bid. Said deposit will be refunded if bid is not accepted. The deposit will be forfeited if the sale fails to close.

4.         Sealed bids must be mailed or delivered to the Bad Axe City Hall located at 300 E. Huron Avenue, Bad Axe, Michigan 48413 on or before 4:00 p.m. on July 31, 2025. Bids not received by the City by said time will not be considered.  “Sealed Bid” must be written on the left bottom corner of the envelope. If bids are mailed, it is the responsibility of the bidder to verify bids are received by the City of Bad Axe.

5.         Upon acceptance of a bid by Seller, Purchaser shall forthwith execute a written purchase agreement. Said agreement shall include a provision that the sale is contingent on the Purchaser constructing an indoor hockey arena within one year of closing. In the event Purchaser fails to construct an indoor hocky arena within one year of closing the title to the property shall revert to the City of Bad Axe. Other related documents will be presented to the Purchaser for their review. 

6.         The Seller reserves the right to accept or reject any and all bids.

7.         Final acceptance of a bid is subject to approval by City of Bad Axe.
